Article 1 These Measures are formulated in accordance with the Regulations of the People's Republic of China on Certification and Accreditation (hereinafter referred to as the Regulations on Certification and Accreditation) and other relevant laws and administrative regulations in order to strengthen the supervision and management of certification institutions, standardize certification activities and improve the effectiveness of certification.
Article 2 The term "certification institution" as mentioned in these Measures refers to a certification institution which has been approved and established according to law and independently engages in the conformity assessment activities of products, services and management systems meeting the standards and relevant technical specifications, and has the status of a legal person.
Article 3 These Measures shall apply to the certification activities conducted within the territory of the People's Republic of China and to the supervision and administration of the certification bodies.
Article 4 The State Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the General Administration of Quality Supervision and Quarantine) shall be responsible for the supervision and administration of the certification bodies.
The State Certification and Accreditation Supervision and Administration Commission (hereinafter referred to as the State Accreditation and Accreditation Commission) is responsible for the establishment of certification bodies and the supervision and administration of relevant examination and approval and their professional activities.
The quality and technical supervision departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the provincial quality and technical supervision departments) and the entry-exit inspection and quarantine organs directly under the Central Government (hereinafter referred to as the inspection and quarantine organs directly under the Central Government) shall, in accordance with the provisions of these Measures, be responsible for the supervision and administration of the certification activities
Article 5 Certification institutions shall abide by the principles of impartiality, openness, objectivity, independence, honesty and credibility in their certification activities and safeguard the social credit system.
Article 6 Certification institutions and their personnel shall be obliged to keep state secrets, trade secrets and technical secrets known to them in their professional activities confidential.
