Article 28 The National Production License Office and provincial quality and technical supervision departments shall be responsible for supervising and inspecting the relevant activities of license inspection institutions and their inspectors in accordance with the Regulations on Administration.
Article 29 License Inspection Institutions shall submit to the provincial quality and technical supervision departments before January 30 each year the annual work self-examination report of industrial product production license of the previous year (hereinafter referred to as the annual work self-examination report, see Annex 5), and shall be responsible for the authenticity of the annual work self-examination report. A licensing inspection institution designated to be less than one year may submit its annual work self-report in the next year. Provincial quality and technical supervision departments examine and verify the annual work reports of license inspection institutions, and fill in the Summary Form of the Self-Examination and Audit of the Annual Work of Industrial Product Production License Inspection Institutions (see Annex 6) and report it to the National License Office.
The annual work self-examination report contains the following contents:
(1) The change of the name of the inspection institution, the name of the affiliated unit, the nature of the inspection institution and the authorized inspection capability;
(two) accept the supervision and evaluation of metrological accreditation, examination accreditation and laboratory accreditation;
(3) The maintenance and change of inspection conditions, such as the management of inspection institutions, inspection equipment and their accuracy and staffing;
(four) the inspection items of production license products are involved in the comparison test.
(five) complete the inspection of products, quantity and charges;
(six) to deal with the disagreement and complaint of the inspection report.
(seven) the daily supervision and inspection of the inspection bodies by the quality and technical supervision departments and the certification and accreditation departments;
(eight) other situations that need to be explained.
Article 30 According to the daily supervision and management of license inspection institutions and the annual self-examination of their work, the National License Office organizes random or special supervision and spot checks of license inspection institutions, and notifies the results of supervision and spot checks.
Article 31 Where the inspection institution undertaking the task of production license inspection has reached five years from the date of appointment, the National License Office shall organize the National License Examination Center to re-appoint the inspection institution after examining its qualification and inspection capability.
Article 32 License inspection institutions use the work of certification inspection to violate the rules for the implementation of production licenses or Article 27 of these Provisions, fail to pass annual self-examination, confirm through periodic or irregular inspection that they cannot maintain the capacity of production license inspection institutions or fail to cooperate with the supervision and inspection workers of quality and technical supervision departments at all levels. Suspend production permit inspection for one year. If it fails to make corrections within the time limit, the National Production License Office shall revoke its qualification to engage in the inspection of production licenses; if it violates the relevant laws and regulations of the State, it shall be dealt with according to law.
Article 33 Upon the expiration of the suspension period, the suspended inspection institution shall apply to the provincial quality and technical supervision department at the place where it is located for restoration. The National License Office shall organize on-the-spot inspection by experts. If the suspended inspection institution meets the requirements, it shall resume its qualification as a license inspection institution.
Article 34 Inspection institutions that have been revoked shall not apply for license inspection again within three years.
Article thirty-fifth any organization or individual has the right to report and complain against any violation of the provisions. The department receiving reports and complaints should keep confidential for the informants and carry out investigations in accordance with the regulations. After investigation is true, it shall be dealt with in accordance with the relevant laws and regulations.
